FTC Approves 2024 Budget for Horseracing Integrity and Safety Authority

The Federal Trade Commission has issued an order approvingthe Horseracing Integrity and Safety Authority’s 2024 budget as submitted to the Commission. On March 27, 2023, the Commission adopted procedures for the Commission’s review and approval of the Authority’s annual budget.

The FTC’s rule regarding oversight of the Authority’s budget process requires the publication of the Authority’s proposed budget in the Federal Register for public comment. After the close of the public comment period, the Commission must either approve or disapprove the proposed budget.

The FTC published the Authority’s proposed 2024 budget in the Federal Register and provided the public an opportunity to comment. In its order, the Commission finds that the Authority’s proposed budget is consistent with the requirements of the FTC’s oversight rule.

The Commission vote to approve the proposed budget was 3-0.

FTC to Host Virtual Summit on Artificial Intelligence

January 25 event will focus on ways to protect consumers and competition

The Federal Trade Commission’s Office of Technology is hosting a virtual tech summit on January 25, 2024 that will bring together a diverse group of stakeholders to discuss key developments in the rapidly evolving field of artificial intelligence (AI), looking across the layers of technology related to AI.

The summit will bring together representatives from academia, industry, civil society organizations, and government to discuss the state of technology, emerging market trends, and real-world impacts of AI. The discussions will also explore how to cultivate a marketplace that allows both consumers and businesses, including startups and small businesses, to thrive.

FTC Chair Lina M. Khan and Commissioners Rebecca Kelly Slaughter and Alvaro Bedoya will provide remarks at the summit. The event will also feature three panel discussions. These include discussions on the hardware and other key infrastructure that will be needed for AI development; issues related to the data and models used in AI; and AI-powered consumer applications.

The summit will begin at noon and take place online. The tentative agenda is available on the event website. Information on how to participate will also be posted to the event pagesoon.

Details

The Parliamentary Under Secretaries of State at the Department for Business and Trade and the Department for Science, Innovation and Technology wrote to the Competition and Markets Authority (CMA) asking it to set out its plans and proposed timelines to implement the new Digital Markets competition regime as envisaged under Part 1 of the Digital Markets, Competition and Consumers Bill.

The CMA has responded confirming that it will publish a document in line with the request in due course.

Microsoft/Activision Blizzard, In the Matter of

The Federal Trade Commission authorized an administrative complaint against the proposed merger between Microsoft Corp. and Activision Blizzard, Inc., a video game developer that creates and publishes games such as Call of DutyWorld of WarcraftDiablo, and Overwatch. Microsoft sells the Xbox gaming console and also offers a video game subscription service called Xbox Game Pass, as well as a cloud-based video game streaming service. The agency alleges that the deal would enable Microsoft to suppress competitors to its Xbox gaming consoles and its rapidly growing subscription and cloud-gaming business. The Commission withdrew the matter from adjudication in July 2023, and returned it to adjudication on September 26, 2023.  The evidentiary hearing will commence 21 days after the issuance of the district court’s decision in FTC v. Microsoft.

IQVIA Holdings/Propel Media, In the Matter of

On July 17, 2023, the Federal Trade Commission sued to block IQVIA Holdings Inc. (IQVIA) from acquiring Propel Media, Inc. (PMI), alleging in an administrative complaint that the proposed acquisition would give IQVIA a market- leading position in programmatic advertising for health care products, namely prescription drugs, to doctors and other health care professionals. The Commission also authorized FTC staff to seek a temporary restraining order and preliminary injunction in federal district court to prevent IQVIA from consummating its acquisition of PMI, pending the agency’s administrative proceeding.

After a nearly two-week evidentiary hearing and closing arguments in late November and December 2023, U.S. District Court Judge Edgardo Ramos issued an order granting the FTC’s motion for preliminary injunction on December 29, 2023.

Chase Nissan/Manchester City Nissan

The Federal Trade Commission and the State of Connecticut are taking action against auto dealer Manchester City Nissan (MCN), along with its owner and a number of key employees, for systematically deceiving consumers about the price of certified used cars, add-ons, and government fees.

The complaint alleges that the dealership, in addition to deceiving consumers, regularly charges them junk fees for certification, add-on products, and government charges without the consumers’ consent, sometimes costing them thousands of dollars in unwanted and unauthorized charges.
