O documento elaborado pelo Cade está concorrendo com publicações das autoridades da República Dominicana, Peru, México, Canadá e Estados Unidos. A votação que definirá o ganhador está aberta ao público até 5 de abril.
A premiação é promovida pela revista francesa Concurrences e tem como objetivo destacar iniciativas inovadoras que promovam a cultura da concorrência e o cumprimento das leis antitruste. Já a categoria Best Soft Law & Studies busca difundir as melhores práticas na área e as ferramentas utilizadas pelas autoridades de defesa da concorrência de todo o mundo.
Publicado em 2023, o guia elaborado pelo Cade visa proporcionar uma compreensão aprimorada sobre como as sanções são determinadas em condenações de casos de cartel pela autoridade antitruste brasileira

12 January 2024: The SAU has accepted a request from DBT for a report concerning its proposed restructuring subsidy for the Post Office Process Review compensation, concerning operational issues unrelated to compensating postmasters for the Suspension Remuneration Review, Horizon-related shortfalls and for overturned convictions.
This request relates to a Subsidy of Particular Interest.
The SAU will prepare a report, which will provide an evaluation of DBT’s assessment of whether the subsidy complies with the subsidy control requirements (Assessment of Compliance). The SAU will complete its report within 30 working days.
Information about the subsidy provided by DBT
Post Office Limited is a Public Non-Financial Corporation (Public Corporation) constituted under the Postal Services Acts 2000 and 2011, and is wholly owned by the Secretary of State for Business and Trade. The Department for Business and Trade (DBT) explained that through Post Office Limited, the government ensures the provision of a network of post office branches, delivering essential services to customers across the UK. It was also explained that the government provides Post Office Limited with subsidy and investment funding and has, since 2021, also provided funding to enable Post Office Limited to manage financial liabilities arising from issues relating to previous versions of the Horizon IT system.
DBT explained that, arising from findings of the Hon Mr Justice Fraser in the ‘Common Issues Judgment’, Post Office Limited has found previous operational issues unrelated to Horizon shortfalls such as processes and/or policies regarding certain services that impacted postmasters financially. DBT is now proposing to award Post Office Limited a grant of up to £81million to enable it to provide redress to postmasters who may have been impacted by the operational issues identified. This is separate to the work of Post Office Limited in compensating postmasters for the Suspension Remuneration Review, Horizon-related shortfalls and for overturned convictions.
DBT explained that the government ‘considers that it is important that Post Office Limited continues to implement improvements following the Common Issues Judgment, including through the delivery of compensation to affected postmasters. Government is therefore proposing to provide this additional subsidy to Post Office Limited to ensure it can carry out appropriate redress. By extension, it is intended that this investment will also support the provision of a stable post office network, providing essential services to customers across the UK’.
DBT further explained that, as the sole shareholder of Post Office Limited, it ‘will continue to provide oversight to ensure that compensation is delivered quickly and effectively to affected postmasters and that operational costs are well managed. The subsidy will be ringfenced for the purposes outlined above and may not be used for supporting other activities undertaken by Post Office Limited’.
DBT has stated that the grant funding will cover the period to the end of the 2025 to 2026 Financial Year and that grant payments will be released to Post Office Limited in arrears on evidence of expenditure and regular reporting. It was also explained that Post Office Limited will communicate with current and former postmasters to outline the scope of the remediation process in the coming months.

12 January 2024: The SAU has published its report providing advice to BCC concerning the proposed subsidy for the Mourne Mountain Gateway Project. The report sets out our evaluation of BCC’s Assessment of Compliance of its proposed subsidy with the requirements set out in the Subsidy Control Act 2022.

27 November 2023: The SAU has accepted a request for a report from Belfast City Council (BCC) in relation to the proposed subsidy for the Mourne Mountain Gateway Project. This request relates to a Subsidy of Particular Interest.

Information about the subsidy provided by BCC
Belfast City Council, as Accountable Body for the Belfast Region City Deal, is proposing to contribute public funding to the Mourne Mountain Gateway Project, a new visitor attraction that will consist of a gondola style cable car from Donard Park in Newcastle, Co. Down, to a proposed new visitor centre at Thomas Quarry. The beneficiary of the subsidy is Newry, Mourne and Down District Council (NMDDC), which is the project sponsor.
The estimated total value of the project is £44 million, which comprises a subsidy of £30 million from BCC and a further £14 million from NMDDC. BCC will be receiving funding for this project from the Department for Economy under the agreed terms of the Belfast Region City Deal signed in December 2021.
The specific policy objective that this subsidy aims to address is to sustainably grow the tourism market in Northern Ireland (NI) by encouraging more visitors to NI, who stay longer and spend more across the region. Without providing a subsidy the market alone will not deliver visitor attractions of sufficient scale across the region to meet the policy objective.
The subsidy will be provided to NMDDC over the delivery period of the project (2024 to 2029) and will be conditional based on the terms and conditions of a Contract for Funding that will be signed between the Department for Economy and the Accountable Body and a Funding Agreement that will be signed between the Accountable Body and NMDDC.

La CNMC sanciona a Cemesa Amarres Barcelona y Mooring & Port Services con 80.000 euros

- En julio de 2021, crearon Amarres de Barcelona, pero tenían que cumplir varios compromisos para mantener la competencia en el puerto.
- Entre otros, no empeorar las condiciones comerciales y no incrementar los precios anteriores de los servicios de amarre y desamarre.
- Entregaron con más de un mes de retraso la información que permite a la CNMC verificar anualmente dicho compromiso.
La CNMC ha multado con un total de 80.000 euros a Cemesa Amarres Barcelona, S. A. y Mooring & Port Services, S. L. por incumplir uno de los compromisos adquiridos en 2021 cuando crearon Amarres de Barcelona S. L JV, actualmente la única compañía de amarres del puerto de Barcelona (SNC/DC/065/23).
Cemesa y Mooring presentaron y aceptaron voluntariamente varios compromisos ante la CNMC (nota de prensa). Entre otros, no empeorar las condiciones comerciales y no incrementar los precios anteriores a la creación de Amarres de Barcelona. Estos solamente podrían actualizarse anualmente y de manera justificada [1].
Retraso en enviar la información
En los primeros 15 días de cada año, las compañías estaban obligadas a enviar un informe anual con los precios de los servicios y las copias confidenciales de los contratos renovados en 2022. Sin embargo, lo hicieron con más de un mes de retraso. Esa verificación es esencial para que la CNMC compruebe y vigile la efectividad del compromiso.
Incumplir los compromisos de una operación de concentración, de acuerdo con la Ley de Defensa de la Competencia (LDC), supone una infracción muy grave en virtud de su artículo 62.4.c. En consecuencia, la CNMC ha impuesto una multa total de 80.000 euros a ambas compañías.
Contra esta resolución podrá interponerse directamente recurso contencioso-administrativo ante la Audiencia Nacional en el plazo de dos meses a partir del día siguiente al de su notificación.

- El Colegio de Ingenieros de Caminos, Canales y Puertos ha remitido una consulta a la CNMC sobre esta materia.
- Los honorarios de los ingenieros deben fijarse libremente —la normativa prohíbe a los Colegios profesionales los baremos o recomendaciones—.
- Excepcionalmente, se permiten los criterios orientativos, pero siempre de acuerdo con la doctrina del Tribunal Supremo y de la CNMC.
La Comisión Nacional de los Mercados y la Competencia (CNMC) ha analizado cuestiones relativas a la elaboración y difusión, con carácter excepcional, de los criterios orientativos para la tasación de costas, a raíz de una consulta del Colegio de Ingenieros de Caminos, Canales y Puertos (INF/CNMC/496/23).
Los honorarios de los ingenieros deben fijarse libremente. La Ley 2/1974, de 13 de febrero, sobre Colegios Profesionales (LCP) y la Ley 15/2007, de 3 de julio, de Defensa de la Competencia (LDC) prohíben a los Colegios profesionales cualquier baremo o recomendación sobre dichos honorarios, con la única excepción de la elaboración de criterios orientativos para la tasación de costas.
Consideraciones
Desde un punto de vista meramente consultivo, y sin perjuicio de las competencias sancionadoras de la CNMC (véase, por ejemplo, el expediente sancionador S/DC/0587/16 COSTAS BANKIA), se señala lo siguiente:
- Elaboración de criterios orientativos de honorarios: la LCP no establece que sea obligatorio elaborar criterios orientativos, sino que se trata de una posibilidad para los Colegios profesionales y se limita exclusivamente a la tasación de costas.
- Factores que considerar para elaborar los criterios: los Colegios profesionales deben valorar este aspecto de acuerdo con la doctrina del Tribunal Supremo (es necesario considerar una pluralidad de factores y ponderarlos adecuadamente). Además, no debe incluirse ninguna referencia numérica o cuantitativa —tarifas, porcentajes, coeficientes, escalas o valores de referencia—.
- Órgano de aprobación: la CNMC no es competente para valorar el órgano que debe aprobar los criterios orientativos.
- Publicación de los criterios: no entrañaría, a priori, riesgos para la competencia si son auténticos criterios orientativos a los exclusivos efectos de la tasación de costas. En todo caso, cualquier difusión, dentro o fuera del Colegio, no debe contener referencias numéricas o cuantitativas. Tampoco deberían publicarse los informes de tasación remitidos por el Colegio profesional al órgano judicial en el supuesto de impugnación de la tasación.
Cambio en los estatutos
La CNMC insta al Colegio a adaptar sus estatutos y eliminar, como una de sus competencias, la aprobación de baremos de honorarios de carácter orientativo.
La distinción entre baremos (prohibidos por la LCP y la LDC) y criterios orientativos (permitidos) es de capital importancia.
También recomienda a los colegios profesionales que autoevalúen los criterios orientativos de acuerdo con la doctrina del Tribunal Supremo y de la CNMC.
Este informe se emite a solicitud del Colegio de Ingenieros de Caminos, Canales y Puertos, en ejercicio de las competencias que le atribuye el artículo 5.2 de la Ley 3/2013, de 4 de junio, de creación de la Comisión Nacional de los Mercados y la Competencia.

FTC Announces 2024 Jurisdictional Threshold Updates for Interlocking Directorates

The Federal Trade Commission has approved revised jurisdictional thresholds for Section 8 of the Clayton Act, which prohibits interlocking directorates. For 2024, thresholds under Section 8 of the Act that trigger prohibitions on certain interlocking memberships on corporate boards of directors are $48,559,000 for Section 8(a)(l) and $4,855,900 for Section 8(a)(2)(A).
The thresholds for Section 8 of the Clayton Act become effective upon their publication in the Federal Register. A complete listing of current thresholds can be found on the FTC’s website, and will be updated closer to the time they become effective.
The vote approving the Federal Register notice announcing the threshold revisions was 3-0.
